• “Service”: Refers to all content and resources available on the Website, provided by HO Digital and accessible during browsing, account creation, or purchases.
• “Territory”: Refers to the following territory: mainland France, including Corsica.
• “User”: Refers to any individual accessing the Website, regardless of their location or connection method.

SECTION 3 – WEBSITE ACCESS AND USE

Accessing and using the Website implies the User’s unreserved acceptance of the Terms of Use (including these TOU, the DPP Policy, and the Legal Notice). By accessing the Services, the User confirms they have read and understood these TOU and agrees to comply with them.

Users who do not wish to accept all or part of the TOU or any subsequent modifications must refrain from using the Website.

To use the Website, Users must have equipment compatible with HO Digital’s minimum technical specifications. Users are responsible for ensuring their equipment is compatible with the Website and the products/services offered. HO Digital cannot be held liable for any User’s inability to access the Website.

SECTION 4 – ACCOUNT CREATION

Users can, but are not required to, create an Account on the Website to access and enjoy specific Services or offers, such as:

• Accessing details of past and current Orders.
• Viewing Order details, including invoices.
• Managing saved addresses, adding, editing, or deleting them.
• Changing passwords.
• Leaving reviews for Products or Services (reviews may not always be published).

By creating an Account, Users accept these TOU and the DPP Policy. Creating an Account does not automatically subscribe Users to HO Digital’s newsletters.

Account creation is limited to individuals aged 18 and older with full legal capacity.

When creating an Account, Users must complete all fields in the registration form except those marked optional. Incomplete forms will result in non-creation of the Account. Users are responsible for providing accurate information.

Upon account creation, Users receive a confirmation email on the same day. HO Digital reserves the right to delete any Account that violates these TOU.

Users are prohibited from posting:

• Content infringing on others’ rights (privacy, image rights, etc.), defamatory, offensive, obscene, or harmful to minors.
• Violent, pornographic, or criminally provocative content.
• Content that encourages discrimination or racial hatred.
• Content promoting illegal actions, copyright violations, or unauthorized content sharing.

HO Digital reserves the right to modify or delete any Account or content violating these rules.

SECTION 5 – INTELLECTUAL PROPERTY

The Website is the exclusive property of HO Digital. Its content, including text, images, databases, and software, is protected under French intellectual property law. HO Digital grants Users a personal, private right to view Website content for non-commercial purposes only.

Reproduction rights are limited to digital copies for personal use and private printing within legal allowances. Any other use requires prior written authorization from HO Digital.

HO Digital also disclaims responsibility for any user-generated messages, content, or information. Errors or omissions reported to HO Digital will be corrected as soon as possible, and HO Digital reserves the right to modify the Website or these terms at any time without liability.

In no event shall HO Digital be liable for any direct or indirect damages resulting from the use of this Website.
